1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Strutiva, a brand of The Nelson M Group LLC ("Strutiva," "we," "us"). They govern your use of strutiva.com and related services, among them email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree to them, you should not use the Services.

2What Strutiva is, and is not

Strutiva is an information service. We publish general, plain-language information about how insurance works, how to read a policy, and what tends to affect insurance costs, and let visitors opt in to related updates. We will not sell insurance, give quotes, rates, or price estimates, match people with agents or insurers, or refer people to providers, and we will not share your details with agents, insurers, or other third-party partners.

• Decisions about your insurance are yours. Reading our content does not obligate you to do anything.
• Your own insurer or agent, not Strutiva, explains the terms, limits, exclusions, and costs of any policy, and is responsible for your coverage.
• Costs, coverage, and savings vary by person, plan, and location. We never guarantee that you will save any amount, qualify for any coverage or discount, or get any particular result.

3Eligibility

To use the Services you must be 18 or older, be located in the United States, and have the capacity to enter a binding contract. Send us information only about yourself or about someone who has given you permission to do so.

4Your information and accuracy

You promise that what you submit is accurate and up to date, and you will update it if anything changes. The mobile number you enter must be one you own or have authority to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5Communications and text-message consent

You agree, if you opt in, to receive email from us and, only for the boxes you check, automated text messages as outlined in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 6Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-551-0336.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

7Acceptable use

Do not (a) submit information that is false, misleading, or belongs to someone else, (b) use the Services unlawfully, fraudulently, or abusively, (c) disrupt the Services or attempt unauthorized access, (d) fill in forms with bots or automated means, (e) copy, scrape, or resell our content without permission, or (f) impersonate anyone. If you do, your access may be suspended or ended.

8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example state insurance departments, consumer groups, or insurers) belong to third parties. We endorse no product, plan, or provider, and we take no responsibility for the conduct, content, or outcomes of any third party. Your relationship with an insurer or agent is between you and them.

9Intellectual property

The Services, including the Strutiva name, logo, text, graphics, and design, belong to us or our licensors and are protected by intellectual property law. You receive a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial reasons. Photographs on the Site are used under their own free-use licenses.

10Disclaimers

The services and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We never warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Strutiva does not supply insurance, legal, or financial advice, and makes no representation about any policy, coverage, price, savings amount, or claim outcome.

11Limitation of liability

Where the law permits, Strutiva and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, that arise from or relate to your use of (or inability to use) the services or to any insurance decision you make or fail to make. Total liability for any claim relating to the services is capped at one hundred U.S. dollars ($100).

Because some jurisdictions restrict certain limitations, portions of the above may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12Indemnification

You shall indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from all claims, damages, and expenses (including reasonable attorneys' fees) arising from violating these Terms, misusing the Services, or providing a phone number or other data without authorization.

13Disputes, governing law, and arbitration

Informal resolution first. Please let us know about any problem first, at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Small-claims matters and claims for injunctive relief against intellectual-property misuse are excluded. Any other dispute between you and Strutiva or The Nelson M Group LLC that arises out of or relates to these Terms or the Services will be settled by final, binding, individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules. You pick whether the arbitration takes place in your county of residence or by video or phone. The arbitrator can grant the same individual relief a court could, and any court of competent jurisdiction may enter judgment on the award.

Class-action waiver. Both you and Strutiva agree, as far as the law permits, to pursue claims individually only, never as a plaintiff or member of a class, collective, or representative action.

Opt-out. To opt out of arbitration within 30 days of first accepting these Terms, email [email protected] and state "Arbitration Opt-Out" in the subject line, along with your name and mobile number.

Governing law. The Federal Arbitration Act and the law of the state in which The Nelson M Group LLC has its principal place of business apply to these Terms, regardless of conflict-of-law rules. Where the arbitration clause does not apply, the state and federal courts in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. Access may be suspended or terminated by us at our discretion, for example for violations of these Terms. Sections that by nature are intended to survive, including disclaimers, limitation of liability, indemnification, and disputes, remain in force after termination.

15Changes

Updates to these Terms will be posted with a new "Last updated" date. Using the Services after the effective date means accepting the updated Terms. If a change is material, we will notify you as required by law.

16General

These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and us on this subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger or sale of the business.
